Employees 'at risk' of redundancy

Voluntary redundancy and voluntary early retirement schemes

Voluntary early release schemes may be made available to employees within a review. The use of these schemes must have prior Cabinet approval.

Maternity and paternity leave

Employees on maternity, adoption and shared parental leave receive enhanced protection when in a review, where they are already on, or go onto, maternity, adoption or shared parental leave between the date of issue of the Section 188 notice and the final end date of the redundancy selection process.

An eligible employee would have an entitlement to be offered suitable alternative employment without having to compete, that is, to be slotted against a vacancy (subject to the council and employee agreeing that the alternative is suitable).

Secondments

Employees on secondment who hold substantive permanent posts will revert to their substantive position for the purpose of the review.

Fixed term contracts

Employees who have been on fixed term contracts for 4 years and over will be considered the same as permanent employees, unless there is an exceptional or specific reason for the fixed term. This will be considered on a case by case basis.

Employees on fixed term contracts where the end date is beyond the implementation date of the review will be included in the review and selection process regardless of length of service.

Where employees hold fixed term contracts where the end date is before the implementation date, those contracts will expire on the end date in accordance with our fixed term guidance.

Those individuals will be entitled and considered for vacant or new roles.
